本利用規約（以下「本規約」といいます）は、くもたん（以下「本アプリ」といいます）の利用条件を定めるものです。本アプリを利用する全てのユーザー（以下「ユーザー」といいます）は、本規約に同意の上、本規約に従って本アプリを利用するものとします。
1. 本規約は、ユーザーと本アプリの運営者（以下「運営者」といいます）との間の本アプリの利用に関わる一切の関係に適用されるものとします。
2. 運営者は本アプリに関し、本規約のほか、ご利用にあたってのルール等、各種の規定（以下「個別規定」といいます）を定めることがあります。これら個別規定はその名称のいかんに関わらず、本規約の一部を構成するものとします。
1. 本アプリは、AT Protocol（Bluesky等）のタイムラインを閲覧しながら、英語の単語・熟語を日本語で学習するための語彙学習支援ツールです。ウェブブラウザで利用します。
2. 本アプリは、以下の主な機能を提供します。
AIによる解説と校正は、運営者が許可したアカウントだけが利用できます。
1. 本アプリの利用には、Blueskyアカウントによるログインが必要です。ユーザーは、AT Protocol OAuth認証を通じてBlueskyアカウントでログインすることにより、本アプリの利用を開始するものとします。
2. 運営者は、本アプリの利用に際して、ユーザーのBlueskyアカウントのパスワード等の認証情報を取得・保存することはありません。
1. ユーザーは、自己の責任において、本アプリの利用に使用するBlueskyアカウントを適切に管理するものとします。
2. ユーザーのBlueskyアカウントが第三者によって不正に使用されたことによって生じた損害について、運営者は一切の責任を負わないものとします。
1. 登録した単語は、AT Protocolの仕組みに基づき、ユーザー自身のPDS（Personal Data Server）に保存されます。PDSに保存されたデータは、ユーザー自身が所有・管理するものであり、運営者がこれを管理することはありません。PDSのデータは、AT Protocolの仕組み上、公開され、誰でも読むことができます。
2. 学習の記録（クイズの結果）や設定は、ユーザーのブラウザの中に保存され、運営者のサーバーへ送信・保存されることはありません。これらはブラウザや端末ごとに別々に保存され、ほかのブラウザや端末には引き継がれません。
3. PDS側の障害やデータ消失について、運営者は一切の責任を負わないものとします。
4. ブラウザのデータの削除、端末の故障その他の事由によりブラウザの中のデータが失われた場合、運営者はデータの復旧について一切の責任を負わないものとします。
1. 本アプリに関連する全ての知的財産権（著作権、商標権、意匠権等）は、運営者または正当な権利を有する第三者に帰属します。
2. ユーザーは、本アプリを通じて取得・保存した学習データについて、私的利用の範囲内で自由に利用することができるものとします。
ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。
1. 法令または公序良俗に違反する行為
2. 犯罪行為に関連する行為
3. 本アプリまたは関連するサーバー・ネットワークの機能を破壊したり、妨害したりする行為
4. 運営者のサービスの運営を妨害するおそれのある行為
5. 他のユーザーに関する個人情報等を収集または蓄積する行為
6. 不正アクセスをし、またはこれを試みる行為
7. 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル等の行為
8. 本アプリを利用した営利目的の活動（運営者が別途許可した場合を除く）
9. 反社会的勢力に対して直接または間接に利益を供与する行為
10. 他のユーザーに対する誹謗中傷、嫌がらせ、脅迫、ストーキングその他の迷惑行為
11. 差別的表現、ヘイトスピーチ、暴力を助長する表現を含むコンテンツの投稿
12. 性的・わいせつなコンテンツ、児童の性的搾取に該当するコンテンツの投稿
13. なりすまし、虚偽の情報の流布、スパム行為
14. その他、運営者が不適切と判断する行為
1. 本アプリは、以下の外部サービスおよびデータを利用して機能を提供します。
2. AI機能について: 解説を求めた英単語と、校正を求めた投稿の下書きは、Cloudflare Workers AI（Gemma）に送信されます。運営者は送信内容を保存しません。Cloudflareは、Workers AIに送信された内容をAIモデルの学習に使わないとしています（詳しくはプライバシーポリシー第5条）。
各外部サービスの利用規約が別途適用されます。ユーザーは各外部サービスの利用規約を遵守する責任を負うものとします。外部サービスの仕様変更・障害・終了等により本アプリの一部機能が利用できなくなった場合、運営者は一切の責任を負わないものとします。
1. 本アプリには、Blueskyに投稿する機能（学習進捗のシェアを含みます）があります。ユーザーは、投稿内容がBluesky上で公開されることを理解し、自己の責任において利用するものとします。
2. ユーザーが本アプリを通じてBlueskyに投稿した内容について、運営者は一切の責任を負わないものとします。
3. 本アプリは、ユーザーのBlueskyのモデレーション設定（コンテンツラベル、ミュートワード等）に従い、該当する投稿をぼかして警告を表示します。
4. 【不適切なコンテンツ・迷惑行為の禁止】運営者は、不適切なコンテンツおよび他のユーザーに対する迷惑行為を一切許容しません（no tolerance）。第7条各号に該当する投稿・行為は禁止されます。
5. 【通報・ブロック】本アプリには、投稿の通報やユーザーのブロックの機能はありません。不適切な投稿や迷惑行為は、Blueskyの公式アプリ等からBlueskyに通報してください。Blueskyで行ったブロックやミュートは、本アプリにも反映されます。
6. 【対応】運営者は、第7条各号に該当する行為を知った場合、第11条に基づき必要な措置を講じます。
運営者は、以下のいずれかの事由があると判断した場合、ユーザーへの事前通知なく本アプリの全部または一部の提供を停止または中断することができるものとします。
1. 本アプリにかかるシステムの保守点検または更新を行う場合
2. 地震、落雷、火災、停電または天災などの不可抗力により、本アプリの提供が困難となった場合
3. コンピュータまたは通信回線等が事故により停止した場合
4. 外部サービス（Bluesky、Cloudflare等）の障害・仕様変更等により、本アプリの提供が困難となった場合
5. その他、運営者が本アプリの提供が困難と判断した場合
運営者は、ユーザーが以下のいずれかに該当する場合には、事前の通知なく、ユーザーに対して本アプリの全部もしくは一部の利用を制限することができるものとします。
1. 本規約のいずれかの条項に違反した場合
2. その他、運営者が本アプリの利用を適当でないと判断した場合
1. 運営者は、本アプリに事実上または法律上の瑕疵がないことを保証しておりません。ここでいう瑕疵には、安全性、信頼性、正確性、完全性、有効性、特定目的への適合性、セキュリティに関する欠陥、エラーやバグ、権利侵害などを含みます。
2. 運営者は、本アプリの利用によりユーザーに生じた、直接的または間接的な損害について、一切の責任を負いません。
3. 本アプリが提供する辞書検索結果、翻訳結果、テキスト解析結果等の正確性、完全性について、運営者は一切の保証をしません。
4. 本アプリは現状有姿（AS IS）で提供されます。
運営者は、ユーザーに通知することなく、本アプリの内容を変更しまたは本アプリの提供を中止することができるものとし、これによってユーザーに生じた損害について一切の責任を負いません。
1. 運営者は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。
2. 本規約の変更後、本アプリの利用を継続した場合には、当該ユーザーは変更後の規約に同意したものとみなします。
運営者は、本アプリの利用によって取得する個人情報については、別途定める「プライバシーポリシー」に従い適切に取り扱うものとします。
1. 本規約の解釈にあたっては、日本法を準拠法とします。
2. 本アプリに関して紛争が生じた場合には、運営者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
These Terms of Service (hereinafter "these Terms") set forth the conditions of use for Kumotan (hereinafter "this App"). All users (hereinafter "Users") who use this App shall agree to these Terms and use this App in accordance with them.
1. These Terms shall apply to all matters relating to the use of this App between Users and the operator of this App (hereinafter the "Operator").
2. The Operator may establish various rules and regulations (hereinafter "Individual Provisions") regarding the use of this App, in addition to these Terms. Such Individual Provisions shall constitute a part of these Terms regardless of their title.
1. This App is a vocabulary learning tool for studying English words and phrases in Japanese while browsing timelines on the AT Protocol (Bluesky, etc.). It is used in a web browser.
2. This App provides the following main features:
AI explanations and proofreading are available only to accounts the Operator has allowed.
1. Use of this App requires login with a Bluesky account. Users shall begin using this App by logging in with their Bluesky account through AT Protocol OAuth authentication.
2. The Operator does not obtain or store authentication credentials such as passwords for Users' Bluesky accounts.
1. Users shall properly manage the Bluesky account used for this App at their own responsibility.
2. The Operator shall not be liable for any damages arising from unauthorized use of a User's Bluesky account by a third party.
1. Saved words are stored in the User's own PDS (Personal Data Server) based on the AT Protocol. Data stored in the PDS is owned and managed by the User, and the Operator does not manage it. Data in a PDS is public by design of the AT Protocol and can be read by anyone.
2. Learning records (quiz results) and settings are stored in the User's browser and are never sent to or stored on the Operator's servers. They are kept separately for each browser and device and do not carry over to other browsers or devices.
3. The Operator shall not be liable for any failures or data loss on the PDS side.
4. The Operator shall not be liable for recovering data in the browser that is lost because browser data is cleared, a device fails, or for any other reason.
1. All intellectual property rights (copyrights, trademark rights, design rights, etc.) related to this App belong to the Operator or third parties with legitimate rights.
2. Users may freely use learning data obtained and saved through this App within the scope of personal use.
Users shall not engage in the following actions when using this App:
1. Actions that violate laws or public order and morals
2. Actions related to criminal activity
3. Actions that destroy or interfere with the functions of this App or related servers/networks
4. Actions that may interfere with the operation of the Operator's services
5. Collecting or accumulating personal information of other users
6. Unauthorized access or attempts thereof
7. Reverse engineering, decompilation, or disassembly of this App
8. Commercial activities using this App (unless separately permitted by the Operator)
9. Directly or indirectly providing benefits to antisocial forces
10. Defamation, harassment, threats, stalking, or any other abusive behavior toward other users
11. Posting content containing discriminatory expressions, hate speech, or incitement to violence
12. Posting sexual or obscene content, or content constituting child sexual exploitation
13. Impersonation, spreading false information, or spam
14. Any other actions deemed inappropriate by the Operator
1. This App uses the following external services and data to provide its features:
2. About AI features: English words you ask to have explained and post drafts you ask to have proofread are sent to Cloudflare Workers AI (Gemma). The Operator does not store what is sent. Cloudflare states that it does not use content sent to Workers AI to train AI models (see Article 5 of the Privacy Policy for details).
The terms of service of each external service apply separately. Users are responsible for complying with them. The Operator shall not be liable if some features of this App become unavailable due to specification changes, failures, or termination of external services.
1. This App has features for posting to Bluesky (including sharing learning progress). Users shall understand that posted content becomes public on Bluesky and use these features at their own responsibility.
2. The Operator shall not be liable for any content Users post to Bluesky through this App.
3. This App follows the User's Bluesky moderation settings (content labels, muted words, etc.) and blurs matching posts with a warning.
4. [Prohibition of Objectionable Content and Abusive Behavior] The Operator has no tolerance for objectionable content or abusive behavior toward other users. Posts and actions that fall under any item of Article 7 are prohibited.
5. [Reporting and Blocking] This App has no features for reporting posts or blocking users. Please report objectionable posts or abusive behavior to Bluesky through the official Bluesky app or similar. Blocks and mutes you set on Bluesky also apply in this App.
6. [Response] If the Operator becomes aware of any action that falls under an item of Article 7, the Operator will take necessary measures under Article 11.
The Operator may suspend or interrupt all or part of this App without prior notice to Users if any of the following reasons apply:
1. When performing maintenance or updates to the systems of this App
2. When provision of this App becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
3. When computers or communication lines are stopped due to accidents
4. When provision of this App becomes difficult due to failures or specification changes of external services (Bluesky, Cloudflare, etc.)
5. When the Operator determines that provision of this App is otherwise difficult
The Operator may restrict all or part of a User's use of this App without prior notice if the User falls under any of the following:
1. When any provision of these Terms is violated
2. When the Operator otherwise determines that use of this App is inappropriate
1. The Operator does not warrant that this App is free from defects in fact or law. Such defects include defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, and infringement of rights.
2. The Operator shall not be liable for any direct or indirect damages incurred by Users from the use of this App.
3. The Operator makes no guarantees regarding the accuracy or completeness of dictionary search results, translation results, text analysis results, etc. provided by this App.
4. This App is provided "AS IS".
The Operator may change or discontinue the content of this App without notice to Users and shall not be liable for any damages incurred by Users as a result.
1. The Operator may change these Terms at any time without notice to Users when deemed necessary.
2. If a User continues to use this App after changes to these Terms, the User shall be deemed to have agreed to the revised Terms.
The Operator shall handle personal information obtained through the use of this App appropriately in accordance with a separately established "Privacy Policy".
1. Japanese law shall be the governing law for the interpretation of these Terms.
2. In the event of any dispute regarding this App, the court having jurisdiction over the Operator's location shall be the exclusive agreed court of first instance.
